Data Protection Act 2018

As part of NHS Highland, the Directorate is a privacy conscious organisation and is strongly committed to your right to privacy. That is why we have drafted a Privacy and Data Protection Statement, which follows guidelines set out in the Data Protection Act 2018.

Everyone responsible for using personal data has to follow strict rules called ‘data protection principles’. They must make sure the information is:

  • used fairly, lawfully and transparently

  • used in a way that is adequate, relevant and limited to only what is necessary
  • accurate and, where necessary, kept up to date
  • kept for no longer than is necessary
  • handled in a way that ensures appropriate security, including protection against unlawful or unauthorised processing, access, loss, destruction or damage

There is stronger legal protection for more sensitive information, such as:

  • race
  • ethnic background
  • political opinions
  • religious beliefs
  • trade union membership
  • genetics
  • biometrics (where used for identification)
  • health
  • sex life or orientation

There are separate safeguards for personal data relating to criminal convictions and offences.

Your rights

Under the Data Protection Act 2018, you have the right to find out what information the government and other organisations store about you. These include the right to:

  • be informed about how your data is being used
  • access personal data
  • have incorrect data updated
  • have data erased
  • stop or restrict the processing of your data
  • data portability (allowing you to get and reuse your data for different services)
  • object to how your data is processed in certain circumstances

You also have rights when an organisation is using your personal data for:

  • automated decision-making processes (without human involvement)
  • profiling, for example to predict your behaviour or interests

How does NHS Highland Public Health collect data?

There are a number of means by which NHS Highland Public Health collects personally identifiable data, for example:

  • Acceptance for inclusion on a mailing list or database
  • As a result of you interacting with NHS Highland Public Health (e.g. by entering into email or telephone correspondence with an employee of the Directorate)

All personally identifiable information provided to NHS Highland is processed in accordance with the principles of the Data Protection Act 2018.

Is information passed to third parties?

It is NHS Highland Public Health’s policy to only disclose information to third parties if explicitly required to do so by United Kingdom Law.

NHS Highland Public Health will obtain your consent before passing on any information to any third parties.

NHS Highland Public Health does not collect or compile personally identifying information for dissemination or sale to external parties for marketing purposes or host mailings on behalf of third parties.

Visitors to our websites

When someone visits www.nhshighland.publichealth.scot.nhs.uk we collect standard internet log information and details of visitor behaviour patterns. We do this to find out things such as the number of visitors to the various parts of the site. We collect this information in a way which does not identify anyone. We do not make any attempt to find out the identities of those visiting our website. We will not associate any data gathered from this site with any personally identifying information from any source. If we do want to collect personally identifiable information through our website, we will be up front about this. We will make it clear when we collect personal information and will explain what we intend to do with it.
